Long weird story….
I was married to my ex for a few years. She came out as lesbian and left me. During our time together her credit was horrible so every debt was opened in my name, including large loans for dental work on her. When she left we drew up a separation agreement and had it notarized in preparation for a court date. In the agreement we defined that she would retrieve belongings left behind, clean out a building full of crap she stashed away and repay me an agreed amount monthly over a period 5 years.
She made good on the repayment part and started auto drafting the agreed amount from her paycheck into my bank account. She kept stalling on the part of retrieving her belongings and the final clean out. I finally got her to come and retrieve her belongings, I set everything in the house on the driveway for her to take. She sorted through it, took what she wanted and left the rest telling me it was trash. She also did not touch anything in the building she agreed to clean out.
Since that date I have made many attempts to contact her via text, email etc and she is ignoring my requests. She also recently quit her job which stopped the auto repayment and refuses to return my calls. The amount she agreed upon to payback exceeds $15k.
Now the weird part, it turns out that she did not file a piece of paperwork for the person that performed our marriage and thus the marriage certificate is invalid and we are not legally married. So we never actually had to go to court.
Do I have any legal standing to enforce the terms agreed upon in the signed and notarized agreement we made?
