I used my VA home loan benefit to purchase a house in Washoe County, Nevada in August 2021. At the time, I believed I was legally married to the man who co-signed the mortgage and was added to the title. I later discovered he was still legally married to someone else, and didn’t file for his prior divorce until after our home closed. The marriage was annulled in June 2025 on grounds of fraud; final court date is in September.
He still lives in the home. I moved out due to a domestic incident. I’ve paid nearly two years in legal fees and filed complaints with the VA, CFPB, Nevada AG, and others. The VA loan is solely based on my entitlement. I’m concerned the fraudulent co-signing violates loan rules and affects my ownership rights.
My questions:
- Can I petition to have him removed from the deed or loan based on the annulment and fraud?
- Do post-closing “improvements” he may have done without my consent reduce my equity?
- Is mortgage/title fraud something law enforcement can pursue or is this strictly a civil matter?
Any insight from others with experience in annulments, VA loans, or fraudulent real estate co-signing would be appreciated.
