I had a Spinal Fusion on 10/25/24 From the very beginning I could tell that somethin g was wrong. The device that they put in was moving around and I had a pain that I didn’t have before my surgery, I mentioned it to My Doctor, I was told to give it time to fuse. It has never fused, I ended up switching Doctors because the doctor that did my surgery was always vague with his answers, hurrying my appointments, and saying he wasn’t sure why I was still in pain. He sent me to physical therapy that I suffered in pain through it didn’t help, Then they started treating me as if I was an issue like I was lying about being in pain, they even took me off of pain meds for awhile and tried pushing me off to a pain management clinic. The new neurologist on my first visit did an X-ray, I was told I have a Spinal fracture bc the spacer implanted is too big causing the device to move and screws to back out causing the device to shift. I would like to get a lawyer for the pain and treatment I suffered but would I have a case.

That sounds like a terrible experience. I’m sorry, OP. A bad outcome of surgery isn’t always malpractice, but it’s possible an error was made, or your follow up care did not meet the standards of care.
You’ll need to consult with a medical malpractice lawyer, it’s such a specialised field, with complex expert testimony needed, and requires details from your personal medical files. It’s just not something that anyone online can help you determine if you have a case or not.
ETA: I believe that you’ll need a medical pannel review before you can file a case against a public provider. Was this private or public?
I would call a medical malpractice lawyer. Don’t wait too long either, since the deadline is 1 year from when you knew or should have known you had an injury caused by malpractice.
The other poster is correct. Louisiana has more hoops a person needs to jump through to file a case than other states. But if they think the case is worthwhile, your medical malpractice lawyer can help you navigate all that.
