FedEx Driver Forced Me Off Road, Injured Me, Then Fled — SPD Refusing to Classify It as Hit-and-Run (Seattle, WA)

On July 18th, 2025, I was riding my scooter northbound near 10015 Lake City Way NE in Seattle Washington when a FedEx Ground box truck (WA plate D47195F) began aggressively tailgating, honking, and intimidating me. The driver got so close I was forced off the road and crashed. I suffered injuries (foot, elbow, shoulder) and filed a report with Seattle Police that same day. Incident #: 25-202793.

The driver briefly got out, blamed me, refused to identify himself, then left the scene. I have clear photos of the truck, license plate, and visible injuries — but SPD still hasn’t classified this as a hit-and-run, despite the driver:
• Causing the crash
• Failing to provide info
• Fleeing the scene

Under RCW 46.52.020, this qualifies as a constructive hit-and-run, even without physical vehicle contact. I’ve cited this law to dispatch, requested supervisor escalation, and filed a complaint — but SPD told me they’d “get around to it Monday,” even though it’s time-sensitive (I’m preparing a spoliation notice to FedEx).

I’m now preparing complaints to the Office of Police Accountability and the Washington Attorney General, but wanted to ask:

Questions:
1. How can I force SPD to properly reclassify the incident under RCW 46.52.020?
2. Is it legal for them to delay escalation when I’m asserting a statute-based hit-and-run involving injury?
3. Can I include their inaction in my civil claim against FedEx for personal injury, property damage, and emotional distress?

Appreciate any guidance. I’m exhausted and doing this alone — but I’m not letting this slide.
