With the current political movements I have seen things unwinding in ways I never expected, and now do not feel secure that our marriage would hold up/be recognized if Texas decided to retroactively declare it invalid due with it being informal/common law as opposed to a properly filed formal marriage license.
My husband and I decided to enter an informal marriage a few years back, as we didn’t feel the need to include family or religion in our relationship, we didn’t want a ceremony. We are registered with our county.
My understanding would be that I could not go to a more affirming state like NY and file for a marriage license as I would have to attest to not being currently married which I could not do. Is that likely to be true?
My option seems to be hope it doesn’t happen and then deal with the realities when it does, or get divorced and remarry formally. Am I crazy for worrying about this?

That’s not a requirement of any marriage in Texas.

What do you mean by this?
You’re making a bigger deal about this than it really is. Go to your county clerk, fill out the application, wait out the waiting period, and get married.
