I was rear-ended while stopped at a red light last week in California. The other driver admitted fault at the scene, and there’s dash cam footage showing they didn’t even brake.
Fast forward to today: their insurance company is saying I’m partially responsible because my brake lights might’ve been dim (they’re not). They offered 80% coverage for damages and suggested I “let it go.”
I’m confused. Can they even do that? Isn’t rear-ending someone pretty much always 100% the fault of the person behind? I haven’t signed anything yet.
Not sure if I should push back, talk to a lawyer, or just accept the partial payout. Any advice or experience with this kind of situation?
