Gym charging me after contract ended,..can I fight this? (US)

Yo, quick question for anyone familiar with contracts or consumer law in the US

I had a 6 month gym membership that clearly ended on Jul 31 2025, with Auto-Renew turned OFF. Their billing was monthly, no problem there, until I checked my statements and saw charges on Aug 1 and Sep 1, 2025. Both after my contract ended.

I’m broke right now, and these charges even pushed my credit card balance negative.

Contract says last day Jul 31 2025

Auto-renew OFF

No new contract signed

Yet charges after the end date

I already have copies of the contract, bank statements, and receipts.
Can I

  1. Dispute the charges for a full refund?

  2. Sue for damages (overdraft fees, financial pain) since this caused real hardship (negative balance in credit card)?

  3. Or just go through small claims if they don’t fix it?

Not looking for a big payday, just wondering if I have legal ground here. Any lawyers or folks who’ve dealt with this before

what’s the best move?

Are you sure “auto renew” being off doesn’t just mean that you don’t automatically get locked in for another 6 months at the conclusion of the first?

Are you sure the contract ends and your entitlement to attend the gym ends on the date specified in the contract? Most of these contracts keep going until you specifically and intentionally cancel them, on a month-to-month basis, after the fixed term portion ends.

Step one is to read your contract and get in contact with the gym about this. I wouldn’t be surprised if your contract continues month-to-month and you have to take specific and deliberate steps to cancel it.
