How bad is a hiccup in a background investigation?

r/

My husband has been applying for a LE position and has had lots of interest and so far two agencies are starting his background investigation. The first is his top pick department, and he met with his investigator on Wed. of this week, and just yesterday he received a phone call from her regarding his court records, which he did disclose in his GIGANTIC questionnaire.

Mind you, my husband is straight and narrow. Never used drugs, never smoked a cigarette, and only had a beer here and there in the military. For reference he is 33y/o now.

We did see a case file dated back to his senior year in high school and he assumed this was from a J-walking ticket since it was unspecified. Apparently about a month later, him and some high school friends were hanging out late one night at some office buildings on their BMX bikes and a neighbor called the police for a potential burglary. When the police arrived, they saw that there was no burglary in place, but unbeknownst to my husband, they had cited him for prowling and contributing to the delinquency of a minor. He said that he does not remember signing anything and he was let go. The case read as dismissed online and he never appeared in court. But of course, I’m sure it looks like he was trying to hide this from the background investigator, even though we included the court records. She did say because he was with in 48 hour window. He is fine, but of course we are concerned now. How bad is this?

If it happened like you’re saying then it shouldn’t be a problem.

Wouldn’t worry about that one at all. As long as he listed it in his packet. Good luck on his process!

When adjudicating backgrounds, (among other things) they are looking for patterns, age at time of occurrence and how much time has passed since the incident. Failing to disclose is a biggie, but given the data on the three things mentioned above, I would suspect that those would mitigate his failure to disclose, provided they think it was unintentional. Hopefully for him they will attribute it to “young and dumb” and not worry about it.
