Conservatorships aren’t just handed down from on high. There has to be someone motivated and willing to pursue the conservatorship and take over power of attorney. For whatever reason, Britney’s family saw fit to do that but Kanye’s never has. I don’t think anyone knows why except for the people directly involved.
Conservatorships also aren’t a punishment. They’re for people who are not mentally competent to handle their own affairs. While that may apply to Kanye, his being racist/vile/hurtful isn’t really a factor in whether or not he’d be a candidate for a conservatorship. (For that matter, I think a conservatorship was probably appropriate for Britney given the extent of her mental illness, but unfortunately she doesn’t have anyone actually looking out for her best interest so it ended up just being another way to exploit her.)
I’ve said it before and I’ll say it again: Britney’s dad should get Ye into a conservatorship.

Because her father spearheaded the effort. She had had a very public breakdown and she was manipulated into agreeing to some level.of control. Britney is an agreeable person. She was very young and a case was made that the conservatorium was for her own good following a temporary break from reality.
Kanye had control over his finances and was middle aged when his break from reality took place. While it is fairly obvious that he is bipolar and a narcissist, those mental illnesses are in line with the grandiose persona of a rapper. The fact that he really believes he is a god and that people are out to get him speaks to real mental illness, but attempts to have him committed by his estranged wife were unsuccessful, likely because of their power dynamic.
You can also make an argument that the end goal for the people surrounding both Britney and Kanye is to strip money from them. That was achieved by making Britney continue to perform throughout her conservatorship as well as by marrying her and obtaining child and spousal supporty. Kanye is less easy to control through conservatorship, and so there was less motivation to obtain it.
Kanye was already a middle aged, established and wealthy artist before he went nuts. Britney was under the thumb of her parents since she was a kid.
Brittany Spears never should have been placed under a conservatorship, it wasn’t in her best interests and it was a tool to abuse her and profit off her. Kanye hasn’t been put under one because despite his erratic behaviour, he is able to care for himself and make decisions for himself. Conservatorships are usually for people with such severe disabilities they are completely unable to make personal and financial decisions for themselves , neither Brittany or Kanye need that level of care

Someone would have to apply. Whichever state he resides in won’t take it upon themselves either. For the state to step in, someone has to report him to adult protective services, they do an investigation/assessment of him and then apply. I used to work APS cases and you’d be surprised how many families do not want that role. You’d also be surprised how often the state also refuses. They don’t like people with big bank accounts too much because it’s a lot of work on the state to keep all the money and assets straight. they’d rather a private attorney, family member or someone else do it. Plus, he’s definitely not well but there’s no indication he can’t meet his needs (pay bills, medication management, drive, bathe, etc.)
The Brittney Spears situation is a complete outlier. Most people, even with advanced mental health problems don’t go under conservatorship unless they’re truly and gravely disabled. It’s still a little confounding that they convinced a judge to do it. A lot of sketchy stuff going on. It is the norm to generally let crazy people do crazy things so long as they are not an eminent danger to themselves, or others, or gravely disabled which basically means you are unable to feed and shelter yourself. A lot of people are mentioning sexism etc but there’s plenty of celebrities like Brittney spears that spiraled a lot in their 20’s and aren’t under conservatorship. The Brittney Spears situation was a massive injustice and a significant outlier for how conservatorships work.

We do not know, and we will probably never know what led to Britney’s conservatorship and losing custody of her kids to Kevin Federline. It’s incredibly difficult to even get a 72-hour hold for people in a mental health crisis.

I was a child during Britney’s meltdown and remember it vividly, I made all my Barbies shave their hair off. Britney was on the verge of losing her children. It was clear Britney was not in a good mental state, even if it was PPD. At the time I was pretty sure she was just having a nervous breakdown, now I do believe she was doing some hard core drugs. Watching Britney and Kevin’s chaotic as an adult changed things for me
I genuinely think the conservative was originally done because her family was worried about her. I think they also feared Britney would lose all her money and destroy her career. Remember, Britney was only 24 and was on a path to completely end her career. yes blackout was a great album but I don’t recall it being a huge success. Also her small concerts were likely not making a huge amount, and she lives a very lavish lifestyle. Now that Britney isn’t performing, she’s gone off the radar and good for her. But now she has money from Vegas, although her family took way too much of her money. I do think her parents took advantage of her, but had they not….I genuinely believe she would be in a worse off place. Let’s remember and this is from a huge Britney fan, she doesn’t have many talents. Had her music career ended early, she could have been financially ruined.

The lynchpin scenario that led to Britney’s conservatorship was when she had a mental breakdown and barricaded herself in the bathroom of her mansion with at least one of her sons. It was couched as child endangerment and the family used that legal turmoil as the justification for taking control.

It is incredibly difficult to put someone under a conservatorship. The real question is what happened with Britney for a judge to be willing to put her under a conservatorship. And the answer is clearly none of our business.
Cause the most positive influence on Kanye’s life, his mom, is dead.
Family dynamics. You can claim a young, single woman is mentally inadequate and needs help, especially given some of the things she did to give that impression.
It would take a lot more to convince anyone, much less a judge, that a grown man is unable to function in society. And who would claim to take care of him?
He has no one who gives enough of a shit about him to force the issue. The only people with legal standing are medical staff and immediate family. He’s obviously not under a doctor’s care, so there’s no one there. The only other people would be Bianca (debatable due to the pending divorce) and his kids, who are minors.
Other cases such as Wendy Williams have both family and medical involvement. Probably too much family in her case. Her son spent her money like water.
I think at the time she was placed in a conservatorship she was more valuable to the music industry alive than dead as she still went on to tour and sold music.

Conservatorship can be put forth by a family member, medical facilities, are the states attorney. A family member does not have to take guardianship over someone who’s unable to take care of himself. Nobody needs to be a babysitter, but there does need to be someone in a position to make medical decisions on behalf of the patient who is deemed unable to adequately care for himself. This could only happen if somebody cared enough about him to file a petition with the state or if he willingly sought care from an agency that was interested in helping him get well without his consent. Conservatorship isn’t punishment and there are lots of levels of guardianship.
She had vulnerable children under her care whom she engaged in scary behaviour towards (locking in bathroom) and family members involved in her life. Kanye does not have anyone looking out for him.

Britney had an immediate family who was willing to push for a legal conservatorship, and a judge who failed to understand that bipolar disorder doesn’t qualify a person for conservatorship under California law. It doesn’t, people should only be conserved if they have a condition that makes them permanently mentally disabled, such as dementia, an extremely low IQ, or a traumatic brain injury.
And both Kanye and Britney seem to have bipolar disorder, and neither is permanently mentally disabled. Just seriously challenged.

Great question, and one that gets at how differently the legal system treats mental health based on gender, family dynamics, and public image.
Britney’s conservatorship was heavily influenced by her father’s legal push and a court deeming her unfit after a very public breakdown. She didn’t have many people publicly advocating for her early on, and the courts sided with her family.
Kanye, on the other hand, is surrounded by enablers, business partners, and legal advisors who don’t challenge him or seek conservatorship—plus he hasn’t had a family member push for one, which is often what initiates the process.
It’s not really about the “bad behavior,” unfortunately. It’s about who has the legal power, influence, and motivation to request control—and whether the court agrees that someone is incapable of making their own decisions.
Someone would need to drag his ass into a hospital and prove hes a danger to himself and others.
It’s pretty simple: Kanye hasn’t been in front of a judge umpteen times for criminal self-destructive behavior, hasn’t been 5150’d numerous times, and Kim doesn’t let him directly involve the kids in his self-destructiveness.
Spears had numerous legal problems, was in and out of rehab including court ordered rehab, and directly involved her kids in her problems. She lost her kids and has never explained why. Losing kids is REALLY HARD to accomplish. The system really wants kids to be with their parents, even if they’re not perfect (or even close to it). And the final straw was refusing to let her kids go at the end of a visit.
All told, that’s a decent argument for conservatorship. Kanye probably would benefit from conservatorship based on his actions, but he’s better protected by people in his life that keep him from escalating to the point of court intervention.

Men are forced under a conservatorship at much lower rates than women for the same or equivalent behavior.the legal system is more likely to perceive adult women as childlike and needing a parental figure to guide them than adult men. Society tends to also have this outlook. Males are instead looked at as being morally flawed. When men have that behavior it’s more difficult to intervene until they commit a crime. This also carries over to attempts involuntarily institutionalize for mental health issues. 72 hour holds are granted for women far more than men.
This also has a basis in historical property rights. American legal code is based on English common law. The Supreme Court has even, relatively recently, verified the right to interpret laws using this as a source. If you do a historical search tracing back laws on women’s rights you will eventually get to a book written in England before North America was colonized. In this book the process of the transfer of property rights over women, from father to husband, is written in detail. It includes the compensation to the father or husband should the daughter/wife be violated. This book was used as a law textbook book in the US until the early 20th century. It is very influential in the U.S. legal code. There can be no doubt that the book identifies women as property, because it openly says that. On the other hand men are explicitly declared to not be property at a certain age (I think 16 but it’s been a decade since I read it). They become the holder of property and much of the rest of the book is about property rights of men. It is very much against taking away those rights for any reason other than serious criminal activity. The act of conservatorship for women is perceived as returning a person who is seen as making poor decisions to the guidance of a father figure (conservators for women are frequently older men).
This sounds like a stretch but it was the basis of why a man raping their wife wasn’t a crime until the late 1970s in the eyes of the U.S. federal government. It was the basis of why sexual assault of someone you have been on a previous date with in AZ wasn’t a crime until about 2010 and then was made the highest class of misdemeanor (I believe it was later changed to a low level felony). I believe the book was written about 500 years ago and has influenced our legal system and perspective at least until 16 years ago. We are still haunted by the bigotry of our cultural ancestors even if we try to break free of their influence.

Lack of family to put him in a conservatorship
I think about this a lot. I’m not gonna just say “I miss the old Kanye” but Jesus Christ, I would give a part of my soul to see into a world where Kanye had never lost the guidance of his mother and the structure that must have existed around her. Sometimes a Kanye song comes on at the wrong time and I remember listening to Through the Wire on the radio with my mom and learning who he was at the time. It’s a good way to have a little breakdown.
I mourn him. He has simply passed away.
I know he became a monster. I know we’re past that point. But watching old videos of him doing Def Jam spoken words, wandering out onto the stage carrying a book bag and dressed in a loose fit polo and jeans, I don’t think I’ll ever stop wondering.
I saw the fundraiser for Hurricane Katrina that he was a part of back in 2005. His record scratch statement about how the president and media at large disproportional targeted and undermined black people (“George Bush doesn’t like black people”, “the news keeps calling black people in the wreckage looters, but the white folks are just looking for food, it’s dehumanizing”) was seen as vehemently awkward, but honestly even as young as I was, that was the earliest thing I remember seeing in the news or elsewhere that “started a conversation”. I talked about race more in the months after than I had ever even thought about before. He made a dent. I was a kid, and he broke my perception of privilege. He generated legitimate understanding in some and outed the racism and hatred in others. And best believe I didn’t see the dipshit looting rhetoric from the media after that. I still bring up that moment in conversation.
The last message we ever got from Kanye of note, I think, was that song that was just his mom’s name spoken to the rate of her heartbeat as she died. God knows he has the heart monitor print out in his closet somewhere under the pile of nipple pasties with his face on them and stacks of shutter shades.
He died at about the same time, in 2007. I don’t think any real part of him walked out of that room, and I think a part of him knows it.
