Hello – 49/M and 49F getting married this year. We both have one child from previous marriage and w both work and make around the same amount. We have a home, and 401k’s are our largest assets. We are wondering if anyone has any advice on how you can distribute things in case of death. I know you can via will or even maybe some in prenup but I don’t know what that would be. Would it be the house goes to spouse and 401k to kid? I can’t decide what is “fair” in this scenario and was wondering if anyone had done anything similar?

This really is something you and your spouse need to discuss and speak to an estate planning attorney about. Everyone’s situations are going to be different, and there are a lot of ways to set up an inheritance that may not be “standard”, depending on what you want to do.
It’s less about what is “fair” and more about both of your wishes for your families.
