I lent my brother my car now he is selling/giving it back to me

r/

Want to start by saying my grammar is very
bad and i apologise

I’m 22 now for context

When I turned 17 I bought my first car a 2012 Vauxhall corsa limited edition with around 78,000 miles, I bought the car for £4,000

After some months learning to drive I came to the conclusion I could not pass my theory test and the car was left sat on the drive for multiple months near to a year not being driven and damaging its self from being on the drive doing nothing. Because of this as well as my brother needing a car at the time for the navy we came up with an agreement which was, He takes the car spends a little bit of money getting it back on the road and then he gives it me back once I have finished my theory.

Fast forward to now 5 years later I still did not decide to pass my theory and he has been using the car the whole time , he is now purchasing a van and won’t need the car but there has been talks of the car being given back to me even though I don’t drive or him selling the car.

My problem is if he gives the car back to me I have to sell the car for very little money because of the amount of miles put on which I feel unfair because I spent 4 grand 5 years ago but could have sold it 4 years ago for majority of my money back.

The other talk was him selling the car which I’ve only found out from over hearing talks between my mum/dad, I also find this unfair because no one has mentioned anything to me about selling it and I’m also wondering how much money I’m still owed for the car if he does sell it as he won’t get much money for it and I feel like that will be used as an excuse to not pay me any money if I’m even owed at all after all this time.

Main question: How much money am I owed for this car?

Car 4k

I paid 3k

Personally happy to take off £1000 for him getting the car back on the road (it wasn’t that expensive)

You’re right to feel like this is unfair you still own the car. If you paid £3k, and you’re fine knocking off £1k for what he spent fixing it up, he basically owes you around £2k. If he sells it, that money should come straight to you. If he just gives it back, it’s basically worth whatever it sells for now, but you shouldn’t be left with nothing. Have an honest talk with him you deserve something back for what you put in.

You’re owed something you paid £3K, and even if you knock off £1K for repairs, that’s still £2K. If he sells it, you should get at least that much or whatever it sells for. It was meant to be borrowed, not his to sell without asking. You’re not being unfair.
