I think I was wrongfully evicted

I am located in NYC, on Friday my family and I were evicted from our home. The Marshal came in and gave us a “marshal’s legal possession notice”. Back in March, someone came to my door with a booklet of papers. It had all this legal jargon about foreclosure. (We are renters) It said nothing about eviction. I reached out to my landlord and he said it was nothing I needed to worry about, a mistake and to leave the papers for him. Since then I haven’t heard about anything. I received no eviction notices. Not in person, not on the door, Not in the mail. I had no idea the home was foreclosed. We are good tenants with a lease signed through a realty company and we pay rent on time every month. Our court date to try to regain possession is on Tuesday. Right now we are in a hotel. We have a toddler and there’s a housing crisis in my city right now. I’m not sure what to do next. I’ve been calling lawyers and legal aid left and right but it’s a weekend so we haven’t heard anything back. I have all my documents ready, lease, zelle payments to landlord, mail etc. I’m really scared what’s to come. We’re up against a bank (they own the house now). I’m really scared they won’t let us regain access, leaving us homeless. We’re law abiding citizens we pay rent we have a child. How could this be happening? We didn’t even know. We could’ve planned. Please help.

    You need to keep looking for a place to live AND consider pressing forward with Legal Aid, if they can accept your case. You have a good case for unlawful eviction and may be able to recoup monetary damages. Where you are homeless, they may be able to take your case. If not, find a good lawyer who knows New York laws, and see where it takes you. The chances of you winding up back in your place is next to nil.
