I’m about to be evicted because my roommate refuses to leave

Hi all,

26F here living with 25M boyfriend and his 65M dad.
Location: MASSACHUSETTS

We signed a lease together initially, but due to my boyfriends dad not being able to pay rental payments and being a pain in our butts, we forced him to sign a roommate release form, with a move out date on paper which we, the leasing office, and he signed and dated.

That day is tomorrow. He has made no effort to move out and instead says “you’ll need to evict me, i’ll take 4-5 months free rent.”

The leasing office is aware of this situation. They told us we have 10 days to get him out or we will all be evicted. The 10 day thing is because once he is off the lease, on the day that the roommate release form was dated (tomorrow), he’s considered a “guest” of the property and we can only have 10 consecutive days with guests staying over in our unit.

With that said, we’ve talked to the police, they’ve said “he has legal tenancy, go to the leasing office” the leasing office says “he’s trespassing, go to the cops, we can only evict the unit not him specifically.” But he’s established legal tenancy even if he’s a “guest”. We have 10 days to have him and his stuff be removed, or we are all screwed. How can I get this jerk out without having to get evicted myself?
Yes, we know he’s a jerk, and we already plan on going no-contact once this is all done. Heartbreak after heartbreak with this man.

We just want to be safe, and we have a little kitty we don’t want to lose. We’ve been paying 90% of the rent the last 4 months, he’s only paid $200 or so each month he’s been on the roommate release form. Now we are not accepting any money from him. We will both lose our jobs if we have no home.
Please help!!

    Normally you are all in this together but tell more about this release form? If landlord signed a form releasing you as one of the roommates then you might be off hook.

    What is cheaper for you, finding a new place and moving or paying him off to leave.

    Both the cops and leasing office are correct.

    To the leasing office, the fact that he’s not leaving is not their issue, it’s yours. They’ll also argue in court, if it were to get that fact, that you agreed by signing the form that he was no longer considered a roommate living there so you should have known he had to leave. Him staying there is in violation of the lease, so they can evict you.

    To the cops, he has established tenancy and cannot just be kicked out. You have to evict him.

    Your best bet to avoid eviction is to serve him an eviction notice as soon as he’s due to be out so that if you end up in court over this, you have documentation that shows you’ve properly served him the eviction notice, and ideally, your eviction process would be over before your own so that a hopefully lenient judge in your own eviction case would cut you a break given the scenario.

    I’d dump the dad and the boyfriend and live a happy life. Boyfriend needs to man up and get the dad out. Tough love but true. You have a life to live, Dad seems like a POS free loader.

    Simple say he tried to molest u n file a case with the cops once they take him to jail u get all his stuff out n change the locks. Also file a restraining order saying he tried to assault u..they will order him to be at least 1000yards away from u..its nasty but ur female n it will work.

    Offer him cash to move out? What does your bf have to say about this? You might want to secure another apartment before eviction shows up on your credit report. I hope your bf learned his lesson about letting family live with you. Good luck.
