Is my company paying overtime correctly

r/

Hello everyone, I work from Tx or well based in tx but i travel. So i work regularly overtime, many times overtime throughout the week. Ex, Mon13Hr, Tues14Hr, Wednesday 13 hr. Well my company pays overtime daily above 8 and 2x above 12. So in this case I have 40 hours by wednesday EOD, now when i enter hours for thursday and friday, 8 hours are being added into the regular time column (to meet 40, as 8 hours each day up till wednesday is 24, so thursday/friday will be 8) and the rest is then correctly being split up as OT. Now am i misunderstanding FLSA that any hours over 40 in a week have to be overtime? They state that because they pay overtime on a daily basis, it would double dip overtime if for ex, i had 40 hours(10 of these being overtime) but now that im over 40 total for the week , shouldn’t every hour be overtime no matter what

Texas has no daily overtime requirements. Let’s say you had 50 total hours in a given work week you are owed 10 hours premium pay.

No, when the hours that are paid as overtime are worked is immaterial in the eyes of both Texas law and federal law. If at the end of the work week you have worked fifty six hours they only owe you sixteen hours of overtime, so they’re correct.

Since your employer chooses to pay daily overtime you could in fact get overtime pay when it is not legally required by law, but I don’t see anywhere you could end up shorted for overtime.
