My dad died in October. He had no will and no life insurance. His estate is in probate still and I’m the administrator. His girlfriend has continued to live in his home since he passed, which we were fine with, as he lived in a long since paid off mobile home on land he was part owner of. Well, she finally moved out this week. His house is basically empty now. Many of these items are currently tied up in probate for the estate. That being said, there’s not a specific list of all of his possessions unfortunately. We really only worried about the big ones like his tractor, his shop full of tools, etc. We know things that he paid for that she took. Do I file a police report if she refuses to return the stuff? How does that work since I technically don’t have any right to anything yet? Do I contact my lawyer handling the probate and estate stuff? I tried calling my lawyer this week when we noticed she was taking stuff but he’s on vacation for the 4th apparently. Just looking for where to start.

The police aren’t going to get involved. Talk to your lawyer. What’s the value of the item she removed?

You have the right to everything. That’s what being administrator means.
You need to secure his estate. If someone is stealing from the estate, make a police report and start a lawsuit against them.
