Will filing and serving a Notice of Appearance get me another 3 days?

Should I get it filed ASAP or at the last minute to maximize the usefulness?

Do those three days include weekend days, or are only business days included?

Thank you

I’m really behind the 8-ball on this. I did literally everything that can be done to salvage the marriage and redirect toward reconciliation, but I have come to understand this is her family business, and will be the 10th divorce amongst her parents, siblings and her. She’s been laying the ground work for over a year now to make it happen and ensure favorable results, which being the sap I’ve been, Im pretty sure are going to happen for her. When I was served, I was devastated, and couldn’t force myself into action for two weeks, I know, I know. So Ive spent most of this week finding out that the lawyers I have called arent able to take me on or are not affordable. Its wasted three of my remaining 5 days. I cant do the legal aid in the area because thats what shes using, and there is a conflict of interest so they cant help me.

I need that extra time to either a. Somehow come up with another couple grand, or b., figure out how to appropriately Answer and Counterclaim. Probably a few other things too. I don’t have a lot of support or options in this area, so its really challenging, and I dont want to give up completely, even though I really feel like it. So any help, clarity, or advice would be greatly appreciated.

I know shes way ahead and a professional at this stuff, but i don’t want to lose literally everything, like she is asking to have happen in these papers. I do have quite a bit of material to put to use, but I need a little more time.

I got served two weeks agom We have two kids. We have a mortgage and vehicles that I paid for. There is an NCO in effect that took a lot of dishonesty to have granted, but they did it. She want to keep everything of value that is paid off, let me have old furniture that my mom let me borrow. She expects to be able to live in the house for as she needs, and shes asking for like 1800/ month between childcare support. She wants 100% custody. I dont mske anywhere near that, and I got driven into the ground by this woman. While I was there, she spit on me, kicked me, and all around did everything she could to ruin me. I know divorces sre hard on everybody, but I’ve never experienced the type of malicious evil that I am now, and its not only soul crushing, but really hard to figure out how to fight. I gave this woman everything I could and sacrificed my body to it. I was always there for her when she needed it, but when I needed her help, this is what it turned into. I

IANAL. This is not legal advice.

Your post is full of holes and not sure what you’re asking.

Has she filed for divorce? Do you own anything together? Do you have children?

A notice of appearance is just a summons for a civil case. Appear for what?

If she filed for divorce using public assistance, then IMHO you are still on even ground.

Idaho is a community property state. So any assets/businesses/wealth that you or your spouse gained during your marriage will be divided 50/50.

Show up to all of your hearings. Bring all your receipts when the time comes. If you go to the courthouse, the clerk will direct you to whatever forms you need for responding. Don’t be afraid to ask for help from the courthouse or in your hearings with the judge.

Most divorces don’t need lawyers. Only when one or both parties cannot come to fair and equitable distributions of marital assets or child custody disputes.
