Ex is a pervert (whole thing there, tried to get daughter examined 9 times, detective was not available for a month and she healed when he finally had her looked at, so no “proof” there. Have a video of her saying dada tapping at her privates during diaper change but I can already hear someone saying “she taught her that”), court is the 22nd, only proof I have is recordings of his phone where he watched daughter theme prn, and nudist colony video purchases with minors (not illegal but he masturbated to one of them). I left in October 2024 with our toddler (14m then) and went to a DV shelter. I was four months pregnant and #2 baby was born four months ago. Had an EPO but the judge just missed it on July 9th because when she asked me why my attorney wanted the court date stricken and I was honest and said he thought it’d be beneficial and she threw it out. Ex is trying to get 50-50 custody even though he doesn’t have a drivers license or a car and we live nowhere close (he doesn’t know where we live). While the EPO was still in place his mom was asking people where we lived. She does meth, he smokes weed, and drinks, and doesn’t have a medical license, and they live in a trailer with seven people total.
The main advice I’ve heard is not give them over to him until the custody hearing, have them talk to my attorney instead of me, and when court rolls around request hair follicle tests. They weren’t listening when I had an attorney and kept trying to contact me directly, and at one point, his mother pulled into a business I walked into and sat outside staring at the building and then drove away. When I was with her son, we had to move in with a friend because he got us kicked out of my mom’s and she found where we lived because she drove around until she found my car. When we left, we lived in conditions that would have gotten our daughter taken away because we didn’t have a lot of things (hot water, adequate AC, fridge or freezer, way to cook beside microwave).
Give me any advice you have. I need to present anything and everything that I have and I don’t know how to do it and I don’t know if I will have an attorney on time. I’ve applied for legal aid. I’ve asked different people and places, and the best answer I have at the moment is to go to the domestic victim shelter again next week when their attorney is in office on Monday. She’s very busy though and I’m unsure if I’ll have her for the hearing. I was told I get 30 minutes to present evidence or reasons not to let the girls go with him and he gets 30 minutes. Alternate idea is offering him zero child support in exchange for rights. If his mom is present, I don’t see him taking it, but if she’s not in the room, I totally see anything about it. I don’t know what to do, but I’m trying my best to keep the kids safe
