Malpractice Case for Failed Abortion

So a couple years ago my girlfriend at the time became pregnant. We went to have an abortion and they said everything went well. A few weeks later I took her to the hospital with abdominal pain and it turned out that she was still pregnant and there were twins. We ended up losing one of the twins. We love our baby boy so much, but the trauma and heartbreak that has come from the failed abortion and posing a child has weighed heavy on my wife. She feels like the issues came from the decisions we made.

    You could try that but you might also have luck with a child support case due to wrongful birth.

    Abortion is a surgical procedure, and as such, it comes with risks and complications, one of which is failure. Any time you get surgery, you’re required to sign consent forms saying you understand the risks involved and are still choosing to get the surgery anyway. Malpractice looks at whether or not the doctor deviated from the standard of care and, if so, to what degree did that affect the patient’s quality of life. If there is no evidence that he acted egregiously by the standards of other doctors, there is no case. No surgery is foolproof.
