Location: Columbus, Ohio My sister and brother-in-law sold their home and the new owners gave them a couple of weeks to move out after closing. I helped them move yesterday and removed the retractable screen door and curtain rods from their home as I thought it was written into the contract for them to retain as had been previously discussed. However, only the curtain rods from their living room and the nursery were actually written in, so there was some confusion/miscommunication about what they had wanted to write in versus what they actually wrote in. Within an hour of vacating, the buyer’s agent texted my sister’s agent a picture of the missing retractable screen door and missing curtain rods. My sister‘s realtor messaged the buyer’s agent back that “the sister (me) was trying to be helpful and mistakenly removed them and she would gladly bring them back today”. My sister is now panicking that they could be considering suing her for breach of contract because they have not heard back from the buyers agent since yesterday evening when we offered to bring what was mistakenly taken back. Though I’m sure they have the legal right to do so, does it still stand that they can sue for breach of contract even though I offered to take them back immediately. I fully understand why they would be upset because it feels dishonest, but I had just gone off of old information.
