Mom & BF split up, he won’t agree to sell jointly owned home, can’t buy her out either. Does she have any recourse?

Location: Illinois Mom & boyfriend purchased house together, both are on the mortgage. Relationship has failed, Mom wants to sell and move out of state. BF doesn’t want to sell, and doesn’t have enough money to buy her out either. Mom’s money is all tied up in said house. What are the options here? They are not married, and no common-law marriage in IL.

She can hire a lawyer to file a lawsuit to force the sale of the house.

Mom needs to continue to ensure the mortgage is paid. Whether she is living there or not, she is responsible for the mortgage.

The legal action that needs to take place is called a partition sale. This is expensive, and he will lose. Once he realizes this, he may decide to stop paying the mortgage. The equity split will be determined through that process, so your mom should gather any documentation she has to establish anything other than 50-50.
