Looking for some advice here. My GF and I are in the middle of a nightmare move and I would love some feedback on pursuing legal action.
Some context:
I just moved from Denver to New Jersey and hired movers with “Menards Moving & Storage”. I was originally quoted for 350 cubic feet of stuff and I was charged for ~700 cubic feet when they came to pick it up. I had to move in a hurry and just wanted to get out so I obliged and paid extra.
I called and asked about it immediately after and the CSR team from Menards said they were going to look into my inquiry. Absolutely no updates since (despite calling everyday). This extra cost means that my stuff will be 2x the amount I was originally quoted for. I paid a deposit, half upfront and I’ll be required to pay the other half on arrival.
The fun part-
I was guaranteed that stuff would be to my new place in Jersey’ 4 days ago when I originally scheduled the move. I would NOT have booked this otherwise. I have come to the understanding that Menards is a broker so I got in contact with the company that actually fulfills the service. This company is now telling me that my stuff is in TX, sitting in storage with a 7-21 business day ETA.
I’m incredibly frustrated with this entire process. As I’ve continued to dig into my situation, I’ve been reading horror stories about stuff being auctioned/ damaged from this company and I want to avoid that entirely.
Despite all of the aforementioned BS…This post is more to me than just a complaint about paying extra money and not having my things arrive on time. I don’t know if that’s enough to peruse legal action?
Here are a few concerns of mine if things continue to go awry:

I was guaranteed that my stuff would be here already. My girlfriend is in the medical field- operating in the ER. Some of her documents are with our stuff that’s in TX and she won’t be able to start work next week without it.

I have multiple firearms that are registered in my name that are also with my stuff in TX. What if they magically go missing during the move?
TLDR- I hired sketchy movers that quoted me extra $, they’re not living up to their promise on getting my things to me in the timeframe in which they agreed. Also, I have important items that I need to start work next week and firearms that are registered in my name.
And advice would be greatly appreciated. Cheers.

It’s usually cheaper up front to pay to get your stuff back because they can charge storage fees legally. Pay the cost of getting it fixed, then take them to small claims to get back what you’re owed.
Use any writings you have to demonstrate you have a contract at the originally quoted price. Show how the price you ended up paying was never disclosed or agreed upon.

You need to review your contract and understand the extent and context of that guarantee. What, specifically, did they promise you in writing? What was the remedy in the contract for their breach? Did they promise you discounts? Something else? Nothing at all?

There is no solution for that which is not solvable. Your stuff isn’t going to get from Texas to New Jersey in any short order. Very likely they told you somewhere in your contract not to put stuff like that on the truck.

Does your contract with them allow firearms? Or exclude firearms? Did you insure the firearms? Or are you about to get $0.10 per pound or something for your missing guns?
