the tenant(mother and father) has been living there for 10 years with their son. the tenant has not paid the rent for the past 10 months after my dad raised the rent $100. their son now has brought their girlfriend to live there. she brought in two big dogs. they are letting their friends sleep there. the mother and father are renting a different place in the city for the past year, while they are on the lease for my dads property. the son and girlfriend are not on the lease and staying there now. when my dad passes his property(where the son and girlfriend stay) to another one of his properties, and every time he passes, girlfriend approaches him with one of the dogs to attack my dad, then my dad goes faster on his riding lawnmower. they have said “we are staying here for 3 more years for free” “you guys are going to jail”. the other day my dad was coming from his other property with the lawnmower on the same street. the son came to my dad(over 80) and swung around his crossbody fanny pack and hit my dad with it on his arm, if he didn’t move his arm he would’ve hit his face. the police have talked with my dad(landlord) and with the tenant, and they are always on their side.

    Do they have a lease? Are they month-to-month tenants? Your dad needs to evict them following the correct process, by giving them notice to vacate/pay or quit and then filing for eviction. Has he done that?

    Police tend to not take sides at all with tenancy disputes like this, unless there’s a criminal matter – it needs to be handled with a formal eviction.

    Your dad doesn’t have to “pass his property.”

    He needs to:

    1. Give proper written “notice to vacate.”
    2. Go to court to get an eviction.
    3. Arrange for the sheriff to remove the tenants.

    Happens every day. He just has to actually go through the process.

    Why in the world isn’t your father just evicting them legally for nonpayment of rent?
