Location: Illinois. We recieved a text from our downstairs neighbor a week ago that her bathroom ceiling is leaking. Right away we checked our bathroom above them and found out the shower cartridge ruptured and was leaking behind the wall down to them. We stopped using the shower and there was no more leaking.
Right away I called my insurance to start a claim and plumbers. I had 2 plumbers come and confirm the following week that it was the shower cartridge. They haven’t repaired it yet because I have to schedule water shut off with the HOA.
My adjuster keeps saying that we should be all good on my liability claim and then today out of nowhere, the neighbor tells us she didn’t have condo insurance because she forgot to renew it. Then she told us we need to tell our insurance that we were negligent with our shower cartridge and that we should get our claim denied so her new insurance claim can be approved since we were negligent. We’ve been completely transparent with her this whole time and now it sounds like shes wanting us to lie so she can get her stuff fixed which ultimately is what we all want. We don’t want to have issues with her but at the same time we can’t afford to fix her stuff out of pocket and dont want to lie about all this.
This is what insurance is for so I’m worried how this is all going to turn out for everyone…

Do not lie to insurance. That is a crime, usually a felony. Just keep telling the truth. Talk to your insurance.
Don’t lie. Just tell your insurance it seems like the downstairs neighbor does not have insurance. Even if they had insurance they don’t have to go through them as this looks like the accident came from your unit. Your insurance should still cover whatever damage they have as you are still responsible.
Don’t talk to neighbor at all regarding this situation, at this point. Let your insurance know about what your neighbor said and continue to let them handle it. Your neighbor wants you to commit insurance fraud. “Problems” with said neighbor should be your last concern, this is the same person who wants you to risk a felony because they didn’t renew insurance…
Your insurance will fix it because that’s what insurance does. Do not lie to them. If they can find a way to reject your claim, they will do it. Don’t give them a reason. Be honest and remember, this is what insurance is for.
What she wants doesn’t even make any sense. Your insurance (in the form of your liability coverage) is already going to be paying for her damages, whether that came from cutting her a check directly, or her insurance (if she had it) subrogating her claim to your insurance.
Even if you were grossly negligent, as long as you didn’t purposefully pour water into her ceiling, your insurance would still cover the claim.
Tell her to work with your insurance on her damages.

your policy covers your liability, always tell your insurance company the truth, let them handle the claim.
her policy lapsed and if she makes a claim now to a new policy it’s an existing condition and unless she’s planning on lying to her carrier, I don’t see why she would do this
