My husband has been experiencing serious and ongoing issues with his employer. For the past three months, his paychecks have consistently been late – the most recent delay was 11 days. As of now, he is owed pay for two full pay periods, and there is still no resolution.

Despite repeated follow-ups (which my husband documents via email), the employer only responds by phone, seemingly to avoid creating a written record. Each time, the owner promises payment “on Monday,” but the date comes and goes without any money being deposited.

In addition, our health insurance has been canceled twice due to the company failing to pay their share of the premiums – even though insurance deductions have been taken out of my husband’s paychecks. We were placed on a new health plan after the first cancellation, but that plan was also terminated within a month for non-payment.

This situation is putting a tremendous amount of stress on our family, both financially and emotionally. While my husband would like to leave the job, the current job market makes it very difficult to find new employment – so we’re effectively stuck.

We recently found Glassdoor reviews indicating this behavior has been happening at this company since at least 2020, which suggests this is a pattern.

What legal options do we have?
Would filing a complaint with the Department of Labor be the right first step?
Any advice on how to protect ourselves and pursue action would be greatly appreciated.

    First, begin job hunting immediately. The firm is on the brink of collapse.

    Second, respond to each phone call with your own email, documenting what was said in the conversation.

    Third, report it to your state’s department of labor.
