I am having my (final) case of a bad roommate.
I confronted her about stealing my things and she went ballistic. We have a private landlord who only requests a 30 day notice to move out/ make changes to the lease. I do know you have to give proper notice for getting people to move out.
After she shouted at me for the confrontation I told her either me or her can stay on the lease but it will not be both of us. Knowing she can’t afford it, she then said I can stay on the lease.
I informed my landlord that she would be moving out (on June 23rd 2025) and he said he would have the new lease to me. I have screenshots and evidence of all of the agreements where we agreed to be out by end of July and then she told me her parents would be coming to town to help her move August 1st. It’s rather inconvenient for me but I guess if it keeps me from having to get the law involved one day is fine.
Would my landlord need to issue anything to ensure she is out of the residence by August 1st or is the new lease from August 2025 – end of original lease sufficient? Do I need to retain a lawyer or create a case with law enforcement (non emergency) about a case of trespassing if she does not leave?

Are you moving units as well?
Ideally yes, she should be given formal notice she will no longer be on the lease as of August 1st. Once the new lease is executed and actually in effect, assuming she has agreed to this and that doesn’t change, she will no longer be a rightful tenant. But- make sure only your name is listed, has the start date, and states it replaces or supersedes the previous lease.
Once executed, if she doesn’t leave, she would need to be evicted through the civil process. The police would almost certainly treat this as a civil matter, not criminal/trespassing.
