Location: Utah. Hi, so I believe my fmla rights have been violated but I dont really know how to move forward and would appreciate some advice. This might sound dumb, but Im so lost at this point. Basically I was approved for fmla, It went fine the 1st few months but then my supervisor started arguing with me claiming I didnt have fmla anymore and last month she pulled me into an “investigation” and aksed me about my absences. I told her they were due to my fmla condition and a few days later she gave me a suspension for said absences. I went to my union and told them the problem because according to my approval letter, my fmla was still valid and disciplining me for using it is against the law. They pulled it up saying my fmla expired and I gave them my letter showing them it shouldn’t have but they just told me I needed to call HR and find out why its showing as expired. (No I didnt exhaust the 12 week per year limit and I wasn’t using more than my doc said I needed each month, just to clear that up) It was a bunch of bologna going back and forth with HR trying to get them to tell me what the hecks going on. I got a letter this week with a new approval and case # which confused me further. I called HR again and finally was told my fmla was updated and moved to a new case #( why am I just now being told?) Which is why the old one was showing as expired. I asked them the date coverage began under this new # and they told me 12/1/24, same as the old one, and its good through 9/1/25. I then told them I recieved a suspension for using it and was just trying to make 100% sure I was covered for the days I recieved discipline for. they told me to talk to my supervisor again because theyre showing me as covered 🙄🙄 I talked to my union again today and they told me theyll meet with sup tomorrow but the way he put it made me feel like my sup is gonna fight as hard as she can to keep the suspension on my record. HR updates fmla in managements system so although I dont have access to that, my supervisor does and should of been able to see it. Idk why after 2 months she never checked it.. On top of all this I have not used fmla leave in almost 2 months because I was made to believe I didnt have it and further absenses would result in more discipline/ potential termination which has been really stressful and has worsened the condition fmla was supposed to protect and help me with. I don’t really know what I’m supposed to do but at the very least I want to make sure the suspension is removed. Ultimately my supervisor and HR made a mistake and failed to let me know my case # changed (it should not have taken 2 months for someone to notify me) which is in no way my fault and its not fair I had to suffer for it. Just wanted to ask for advice here because I kind of feel like my work is taking advantage of me not knowing and that theyre not really fighting as hard as they should be for me and wanted to make sure I dont get screwed.
