Location: Clark County, NV – USA (Las Vegas)
My Mother passed away a few years ago. I hired a real estate agent who recommended a probate attorney to handle the sale of the house and my mother’s probate.
The sale of the house is complete, some funds have been transferred to me however there is still about $60k left over the Attorney has kept “to handle” the estate debts (there was 1 credit card that was written off and not for nearly that amount).
In addition to paying the full credit card debt against my wishes (I told him I wanted to negotiate very much at the beginning) he has now stopped responding to emails and phone calls. The last communication I have from his office was in February 2025.
The estate was having difficulty closing ONLY due to the Credit Card Debt. Card debt was sold off to debtors, once credit card debt was sold, credit card company sent me a 1099-C saying the debt was forgiven/her account was closed. The credit card debtors keep trying to “reinstate the claim” but it keeps getting refused (I am assuming because credit card company has forgiven the debt).
I spoke to the credit card company (not the debtors), they stated the Attorney had sent them a check for the full balance of the debt (against my wishes) and since they had closed her account, they sent it back to him a MONTH AGO. This call was yesterday.
The Attorney said that there would be “tax implications” for the estate because the debt was written off/forgiven (the 1099-C).
- The debtor wants me to send the letter from the credit card company saying her account is closed and also the 1099-C. Should I do this? I don’t trust debt companies and I don’t want this to harm my mother’s estate. I also do not want to give them ammunition to reopen their claim.
- Anyone know IF a personal injury attorney will sue another attorney? Google said that’s the type of attorney I need to sue this guy.***
- I’d be sitting in this guys office right now but I live across the country. I know that’s probably not the wise thing to do but I’m damn desperate and I just want this over with.
- The “tax implications” the Attorney mentioned, are they BS? According to the IRS I shouldn’t be paying any estate tax since her Estate is not over $11 million dollars, right?
I am an only child. My mother was not married. She had a will and it was filed with the state. I feel like her estate is being mishandled when this should have been a slam dunk. Am I wrong?
