Probate Question

I can’t get back to my cursor to finish – the case would be in FL specifically Cape Coral. Thank you for reading this if you do. 😁✌️Also, my brother died of ALS related complications, so he was not an able bodied individual.

My brother died in June of 2022. He and his wife divorced in May of the in same year. There has been no probate case filed and I don’t know if there is a will (I don’t think so). At the time, I didn’t question anything.

I did put my name in an insurance beneficiary data base because he had told me years earlier he had u changed the beneficiary to me. I received a letter from Prudential, a typical sorry for your loss here’s the breakdown of payment. It then went on to say that the policy had been paying out since his death in n2022 (I just got this letter this year, 2025) nand I cannot receive my $200 a month until I pay back the $6,100 that was paid out already.

I told them that’s not possible, I did not get any money and am not paying back something that I do not owe. Plus I can’t afford that. I sounded like a cruel joke. They ask me who the executor of the estate is and I tell them I have no idea but I assumed his ex-wife.

I have no idea what happened but they did end up paying me that back-payment. My concern is that my brother and I might be entitled to something. I am considering filing a probate case to find out.And I’ve questioned fraud possibly going on. I am unsure if it’s worth pursuing. EDITED TO ADD: she is listed as his wife on the death certificate even though they were divorced. I don’t know if that’s legal either.
