Location: near Steamboat Springs, Colorado. I think the title explains it well enough. Some years back, I bought 40 unimproved acres with a beautiful view in the Rockies. I had this dream of an off-grid cabin one day. Surrounding properties got built up with 12-16,000 sq ft “cabins.” All services are right at my lot lines now: improved roads, power, water, sewer, etc. Needless to say, this has brought up the value of my property (like, by over 100 times what I paid, at the low end estimate).
I’ve had great fun over the years telling the HOA in not-exactly-polite legalese to “piss off” when they send me bills for various things such as snow plowing, road improvements, and the like. BUT…. now I think it’s come time to subdivide into smaller lots and sell off, as I have ZERO desire to be surrounded by “luxury” log McMansions, so I am never building there. If it’s relevant, my property is smack dab right in the middle of their HOA. Most have had unobstructed views bc of my undeveloped 40 acres. Boy, are they gonna be angry when a slew of big houses get built there, lol.
I know from the County that the plot can be subdivided. What no one seems to know is if the new plots will still be grandfathered out of the HOA like the original plot has been? Any direction would be helpful. I have not yet consulted a real estate attorney. I will do when the time comes, but I would really like to have some idea of what the final determination might be? if you never agreed to be in the hoa they can’t force you to join.
they can make future development difficult as well as ask new owners to join
