I live in NC and my wife and I recently purchased a home. During the purchase process there was a fence in our backyard that was on our property per the surveys. The real estate agent made it seem like it was no big deal and it was our fence. However after closing no survey was issued and the neighbor was claiming adverse possession since they were maintaining the property for 20+ years. Title company wouldn’t get involved and an attorney we spoke to said they had a case and that it would cost 30k+ if we were to try and go the court route. After adjusting our renovation plans we left the fence as but now we want to just get this issue resolved and have the neighbor update the surveys from a property tax perspective as well as insurance since there is a tree on their side of the fence that is still considered ours per a survey. They tried to claim the front of the property where no fence exists but I am not forfeiting that since there is no proof of adverse possession since there is no fence. Would they also have a claim on the front of the property as well? If they want to claim the property in the back I want them to do the paperwork and we can agree to give the land up but if they refuse what are my options as I’ve already paid for countless surveys. Any help would be appreciated. Thanks!
