Location: Idaho. Title says it all really. I moved out of my apartment after 6 years due to an injury at work, not getting paid for months, and not being able to retain my old job which is a whole other ordeal, so I could no longer support myself alone. They charged me almost $3000 for “smoke/cigarette smell and damage” even though I dont smoke cigarettes anymore and have never smoked inside that unit, though my downstairs neighbors smoked cigarettes inside daily. They are charging me for carpet cleaning and replacement from cigarette smell, repainting, fumigating, and refinishing of the 50 year old cabinets. I had complained in the past about my neighbors by calling the managers but nothing came of it. When I contested the charges they said they had no record of my complaints and if I wanted to aquire an attorney I could, and they sent me the invoices from all the contractors they hired to clean my apartment. What can I do? Im not going to pay for damage I didnt cause, but the only evidence I have on my side is a previous roommate of 3 years who can confirm the fact that neither of us smoked and we complained multiple times about our neighbors smoking inside. I dont know the first thing about suing, or how to handle this with even a slim chance of winning.
