Rear ended by a mf with no insurance

r/

Location: Oregon

The accident was caused by a sedan going full speed (35mph), hitting a sedan behind me that slammed his brakes just before getting hit, and that car hitting the rear of my 04 CRV.

Also, apparently, was not very thorough when I got my own insurance and don’t have collision to cover myself but I have extra coverage for if I were to hit someone else. Evidently uninsured motorist insurance apparently only covers bodily injury. So that’s just rude.

I’m not too hurt, sprained wrist, concussion that got a bit worse today, but i’m not really after anyone for injury I just want my car fixed. I’m a single mom and we’re getting by fine, but not in a position where i can just let this slide.

I’m not unfamiliar with small claims, my questions is more should i get like 3 quotes for repair or would i be fine taking him to court with a single quote? I also intend to go after the filing costs and the costs of getting the estimates in the first place because those are around $150 in my area. I own the car outright and really hope it’s not totaled cause it’s old asf and not worth a lot.

If there’s anything i’m missing too, i’d love to know, like is there going to be a titling problem due to costs of repair?

Appreciate anyone who can help!

Better hope this person has assets you can collect or you will wait quite awhile for payment.

The limit for small claims in Oregon is $10k. Sounds like you have a good plan.
