Seeking legal advice about wrongful arrest.

r/

Location: Tennessee. I was pulled over for speeding and arrested after it was revealed that my license was suspended. After doing their research on why, it was revealed by the officers who arrested me that I failed to appear in court in Alabama in April 2025. However, I was in Cookeville, TN, that day, walking miles to get places because I didn’t have a car at the time. I’m prior law enforcement, but it’s been a minute, and I’m unaware of my rights to be able to acquire dash cam footage of the traffic stop and citation, if available. I’m just trying to figure out where to start…

Are you arguing that you didn’t have a court date in Alabama in April 2025 ? Or just that you didn’t know about your court date in Alabama in April 2025 ?

Or are you arguing that the underlying case for which you had a court date must have been based on a false or mistaken identification because you weren’t in Alabama at the time the citation was issued ?

The fact that an Alabama police officer or agency might have made a mistake, or been successfully misled by an impersonator or identity thief, doesn’t make the Tennessee arrest for DLWS unlawful or wrongful.

You need to hire a traffic attorney in Alabama. They will receive that material as an ordinary part of discovery.
