Someone crashed into me in a no fault state (florida)

r/

So someone on an electric scooter hit my back tire and sustained bodily injury. The day of the accident we exchanged info (only name and phone number) and i texted him saying theres no need to get insurance involved due to minimal damage to my car. He then texts me days later asking me for my insurance information. Keep in mind I am in florida a no fault state, where everyone trys to sue each other for anything even though it was completley his fault and he would have no case against me. As a recent college grad and new resident of Florida I dont have the funds to have my insurance increased, but i also dont have the funds for this to be escalated with attorneys. What should i do?

Notify your insurance company. You’re about to receive a demand letter and your insurance was requested so they can see the limits they provide.

Less popular, sue that idiot for the physical and emotional damage they incurred on you

You should probably inform your insurance. If months or even years later, at any point within the statute of limitations, he decides to take legal action? Your insurance may not cover you because you didn’t report this. In fact your policy may require you to report it, you should check your policy.

This isn’t a typical no fault situation. He wasn’t driving in a car. I’m not intimately familiar with the nuances of Florida no fault insurance, but I wouldn’t be so sure that it applies in this case. Or at least that it applies fully in this case. Imagine for example that you ran into a pedestrian. You couldn’t just say, “but Florida is a no fault state.“

All that said, it sounds like he was at fault. He may claim otherwise. I would be reading through my insurance policy today and I would seriously consider reporting it to them. Is he claiming an injury?

I remember when I was 18. Had my own car and my own car insurance. I was at work, in the parking lot. My dumbass got a ride on the hood on a coworkers car and he slammed on the brakes. I went flying. Broke my collar bone. My parents car insurance had to deal with it. I was so confused why it wasn’t mine. (Still don’t know, this was in 1999).. I really don’t know any details about who’s insurance paid for what. I just thought it was odd that car insurance dealt with it and that it was my parents, even though I was over 18 and working. But I was still in high school.
