Questions like this are extremely hard to answer because, who knows what would’ve happen? Data didn’t plan for the situation where he’d lose the trial, neither did his colleagues in the starfleet.

What most likely would’ve happen is that Picard would try to escalate to a superior court until they’d recognize Data’s rights or the appeal was denied
Considering Picard show, I suppose they would have succeeded in replicating him eventually. Data, however, would probably be dead, and so would the crew of Enterprise since half the time he is saving that ship of trouble.
