State officer pulled me over for speeding, I do not think I was.

Michigan State police officer pulled me over today morning for going “70 in a 55”. He said he’d give me a break and charge me for 1-5 over.

He was NOT using a radar. Ticket says device: (blank).

The ticket says the detected speed is 70mph. Speed charged: 1-5 over. I’m assuming this is 0 points, but it’s such a hefty fine. Here’s my side of the story:

I was driving in the left lane, with the cop in front of me. I saw 3-4 state troopers on the way pulling people over so I was careful. I just stayed behind him, didn’t tail him or anything, and just drove normally. He changes lanes, goes all the way to the right line, now he is 4 lanes to my right. I do NOT speed up, if I do it’s MAYBE to change lanes. I see him start changing lanes, he gets behind me and instantly pulls me over. Things to note:

  • I do not think he had the proximity to pace me in the rightmost lane, nor did he have the time to pace me when he got behind me as he instantly pulled me over.

  • When he pulled me over, I explained how I was behind him and did NOT speed up. He said “It looks like you sped up a bit, I think you were going 70” (note the “think”)

  • It does not seem like he used a radar, since the ticket says DEVICE: (blank)

  • I want to fight it, but I’m afraid they can charge me for the detected speed, which would give me points. Can this happen?

What do you guys think I should do? If he caught me on radar, I would’ve been like eh maybe I wasn’t paying attention and going a little too fast and would have paid it. But it really seemed like he was just trying to pull me over from the start.

    Get a lawyer and go to court. It’s your only real hope of winning this considering the officer reduced it to 1-5 over. In your post here you can’t even say you absolutely didn’t speed.

    Traffic courts generally give fairly wide leeway to an officer’s judgement. Unless you have some kind of evidence that shows your speed was less than the officer testifies, you’re not likely to prevail.
