They knocked on door I opened they asked to speak with. I asked what the issue is they told me nothing. They said just need to speak. I was wanting to close the door they put a foot to prevent that. I spoke with my son. He was not sure. I said a few minutes. They gave me 60 seconds or they were intruding. He came to the door they locked him up and towed his car grabbed his phone from my wife. They told me nothing. No warrants no paperwork. Nothing. Nothing He is Hispanic with a green card.

    Maybe ICE. Maybe some prior crime that is bad news for green card. He needs a lawyer, especially if it’s DHS/ICE.

    To me, it sounds like one of two things being that they towed his car and took his cell phone. He either was street racing and they’re towing his car and took his phone for videos, etc of it. The second thing that comes to mind is worse, and he was doing something on his phone and in the car that was really not good, depending on his age…..

    Just because they did not show you the paperwork does not mean they didn’t have it. If he is over 18, he is an adult and they don’t need to tell you.

    Get a lawyer. Now, don’t wait

    ICE is unlikely to target someone with a green card. This sounds like a different agency. Generally, they should not have done what they did without a warrant, but they may have had one and didn’t bother to show it to you. They should definitely have provided a receipt for the items they took, but they may give it to him directly or put it in with his documents while he’s being processed. Get a lawyer ASAP.

    Foot in the door is illegal without a warrant. And if they had a warrant, they would just come in.

    This is super typical of police and there are a ton of YouTube videos about the foot thing.

    You never have to even acknowledge the police are at your door if they don’t have a warrant and they’re not allowed to snoop around the house either.

    Law enforcement has been doing a lot of things they’re “no allowed” to do when it comes to immigration detention. They’ve detained people who have been 100% legal with all the proper paperwork and held them in Louisiana or Tacoma. If you think they’re still following the Constitution, you’re naive.

    Sounds scary. Police are really pushing legal boundaries and snatching people off the street with very little explanation/proof/warrants. Good luck to your family as you figure this out. Innocent until proven guilty!!!

    Unfortunately they’re not usually going to volunteer the paperwork, you’d have to specifically say “I need to see a warrant or I have to ask you to leave”. They elude to the idea that you have to comply without actually saying the words – make them say it and show proof. As soon as they put their foot in the doorway I would’ve asked for paperwork, because you’re not coming into my home or taking anyone out of it without a warrant. Doesn’t matter how old the person is that they’re looking for (minor or over 18), if that person isn’t the one standing in the doorway talking to them then they should be asked to provide a warrant.

    They towed the car because they have reason to believe he committed a crime in it or used it in the process of committing a crime. Same with the phone. There’s a chance you won’t get the car back depending on the nature of the charges if he’s found guilty. They love to impound and sell them at auction to fund the dept. People buy their cars back at the auction if either police won’t return it or the impound bill is too high once they decide you can have it back.

    More than likely your stepson knows what’s going on. Of course he’s not going to tell you in that moment, probably scared. Eventually he’ll get a phone call and you’ll find out. Then you can probably bail him out but they may hold him for up to an extra day while they check with ICE to make sure his status is free & clear.

    I hope you had the talk with him about STFU in front of police. In the time between arrest and the phone call you get from him, they’re sitting him down trying to make friends and giving him an opportunity to help himself – ie; incriminate himself. Family of law enforcement here, and even they’ll tell me DO NOT TALK TO COPS. Ask for a lawyer immediately and after they mirandize you ask again for a lawyer. The only time you open your mouth it should only be to say “I need a lawyer”.

    You’ll find out soon. Just breathe. Hope it all goes as smoothly as it can under the circumstances.
