Car is towed from store parking lot(car was left there & after buying from store the driver left & came back about 20min later to find the car was towed)
The tow company demanded that they will only release the car to the person on the title & registration to pick up the car (regardless of driver being on the insurance)
(The NYPD when they tow, doesn’t require the registered person to be there to pick up or be involved in any way)
The sign in the parking lot said $125 to pick up tow
BUT the tow company demanded $250!
They eventually capitulated to release the car to the driver in exchange of $250 & no receipts or other sorts of records.
Question 1: Was the Tow company in the right legally with all of their demands?
Question 2: Was there any way to legally win & get the car back with only paying the $150 & not requiring the registered owner be involved?
Comments
That is typical of tow companies. They often charge a different price for illegal parking tows as they are more demanding as they don’t have the keys and cooperation of the car owner.
They want to only release it to the owner, hence checking that the registration matches the persons ID.
