TX- roofer didn’t complete work on insurance claim replacement

Location: South Texas- rental property out of my region- throwaway, because….
Hired a roofer to replace our shingles/roofing after storm. Had to jump through hoops because house has solar panels. Received an itemized estimate from roofer for removal of panels, replacement of roof and reattachment of panels alongside normal estimate of replacement.

USAA approved and work was done. I was unable to put my eyes on the actual work but roofer was recommended and seemed trustworthy with photos of work in process and completion. Roofer got paid.

2 months later and come to find roofing under panels was not replaced. Hired home inspector to look and inspector saw the same thing I did. Old shingles under panels, new roofing up to edge of panels.

Contacted roofer and I’m getting a small bit of runaround. Roofer said they hired a sub to complete panel work and it sounds like roofer wasn’t even on site. Sounds like they regularly sub out most of their work?

Is this a “hire a lawyer immediately” situation? I’m assuming insurance would put this back on me. Not sure I want to continue business with this roofer. Should I work with a lawyer to get funds back to go with another roofer?
