I have a property with several ingress/egress easements to adjoining properties. One easement has an accompanying Road Maintenance agreement, but the other does not.
Both easements have existing gravel roads.
The users of the easement without an explicit Road Maintenance agreement are attempting to pave the entirety of the easement without seeking nor in their words even “needing” our consent.
Everything I have seen or heard includes paving as an improvement activity and not a maintenance activity, and should require landowner approval. The users posit that the easement grants them all rights to do whatever they want to that section, with no input required from me.
Are they legally allowed to just do whatever they want to my property?
Is the only right i have on that land is to pay the property tax?
