Vehicle purchased ended up having structural damage and salvage parts (MN)

I purchased a 2018 Nissan Rogue (44,000 miles) from Wasler Buick GMC Roseville, Minnesota on May 31st of 2025. I purchased a warranty, and GAP. I was not given the carfax or inspection report.

Immediately upon driving it home I noticed it shaking on the highway. I figured it was minor as I’ve had this issue before and it was an easy cheap fix, so I made an appointment. Due to my work schedule, the appointment was set a couple weeks out. In the meantime, I asked for the carfax again, and finally recieved it 4 days later. (3 day return policy.) It was clean, as in absolutely nothing on it.

2 days before my scheduled appointment, the car overheated, and lost all of its coolant. I called the dealership to arrange a tow and asked again for the inspection report. So now we are 3 weeks from purchase, I get the report and saw coolant condition and suspension both failed and no repairs were administered. Information that would have kept me from buying the car.

The dealership had to cover my vehicle since it was less than a month since purchase. A fan assembly was replaced, and I was told the shake was gone. It wasnt. Immediately scheduled another appointment, where they had my car for a week and repaired an axel. Still shakes.

Immediately take the car to a 3rd party mechanic who shows me all of the salvage parts on the car, including every door, and my front bumper, still even have the salvage tags. The radiator is bowed from collision and its bolts are loose. (Didn’t you work on my radiator fans, walser?) 3 of 4 rims are bent and damaged. (Didnt you also work on my axel… that the tires are attached to?) Theres my shake.

I then called the dealership and informed them of all the damage found, and asked for a loaner as I dont feel safe in this car until we can find resolution. The general manager says, “absolutely not. Youre not getting a loaner. Try escalating your problems if you want.”

So I did. I filed a complaint with the AG and BBB. I called my lender, and my warranty, and I called corporate. This was all 3 days ago. The following day, the dealership calls and offers me a trade with no taxes on anything same or lower price. I lose my $3,000 downpayment, go through financing again, and repurchase warranty and GAP. Absolutely not. Youre not getting more money out of me because you misrepresented this vehicle.

Yesterday, the dealership told BBB we reached resolution. I replied with a screenshot of my text declining the offer, because it puts all financial burden on me.

Now its just silence. No one is returning my calls and I want a lawyer, but none of them handle cases with cars this old. I did not purchase this car as is. I bought a warranty for a reason, and the condition of this vehicle was misrepresented, not just to me but to the warranty, and to my lender.

I have everything documented, and im ready to prove their negligence, misrepresentation, and fraud. Where do I go from here?

    You’re supposed to inspect the car prior to purchase, not after. A smart buyer will also test drive it on the highway.

    Dealers don’t know the history of every car that they sell. Used cars are trade ins, old leased vehicles, auction cars, etc. That’s why it’s on you to be a well informed buyer which should include shelling out a few hundred bucks to pay a pro to look at it.

    The good news is that since you have a warranty that covers this stuff, you’re good. It’s unfortunate that they won’t give you a rental, but that’s not required.
