I rented a room via a landlord on FurnishedFinder.com. I stayed for 3 months last year and paid $1050 deposit along with the first month’s rent. Shortly after moving in, I realized that the duplex apartment that I was renting a room in had plumbing issues and was asked by the landlord sometimes to not use the water as the septic was leaking into the downstairs apartment. I moved out on July 31, 2024, sent a text of my new address in Georgia for the return of the deposit, and took pictures and video of the condition of the room and apartment before relocating to my home state of Georgia, because I suspected that I might have issues with getting my deposit back.
I tried calling the landlord’s cell phone number and texting her multiple times and received no response. In March 2025, I sent out a certified letter to the address where the property tax statement is sent every year, demanding return of my deposit after so many days or legal action would be taken. Again, I received no response and the LLC that she used for the rental agreement was adminstratively dissolved in September 2024, after I moved out.
I am prepared to file a suit, but I’m not sure how to and in what court system (probate, etc.). The LLC’s registered agent’s address is in Lynchburg and tax statement where mailed is in Lynchburg but the property is in Roanoke. If I make another trip to Virginia, I would like to handle all the paperwork filing at one time, so I don’t have to take off from work several days. What city should I file in (Roanoke or Lynchburg), what court system should I file it in (probate, etc.), any idea of the cost of the filing, and any other info as to the length of the process and the process itself would be greatly appreciated.
