I have a small stream or water easement (recognized by the US Army Corp) cutting through my backyard in a suburban neighborhood. My direct downstream neighbor created a permanent cement channel that screwed the retaining walls up and downstream 12 years later. To make it simple, the water gets jammed up at the entry to her cement channel and that causes crazy erosion and consequently rapid change to the shape of the stream. She never got permission from the Army Corp or municipality when she did this low bid job. She never got an engineer. I would like to know type of attorney to consult. Should I consider a suit against the city for allowing this? My neighbor? Any other helpful advice would be appreciated. Thanks!
