    Because technically both outcomes were achieved. On the liberal side, the ruling says that Trump has to facilitate the return. On the conservative side, it was tried in the wrong district and the president has the authority to deport.

    Nobody reads the actual court opinion, they read what their preferred media has to say about it. And that – maybe they only read the headlines.

    The opinion said that the executive had to “facilitate” his return to the US, but that asking them to “effectuate” his return might be pushing the line as the executive branch is in charge of foreign policy. It asked the judge to clarify her demand.

    One side hears “facilitate his return” = bring him home, the other side hears “they don’t have to effectuate” his return. It is a subtle opinion issued by the SC – one that pays a lot closer attention to the semantic/legal meaning of the key words than the average American does when they watch the news.

    For a start the decision wasn’t for Democrats or Republicans, it was against the Trump Administration telling them they had to follow a Judge’s order. The Trump Administration, as always, is really blatantly lying to the courts and public about reality and their actions, They will out of one side of their mouths claim Garcia was wrongfully sent and they are trying to comply with the law but their hands are tied, and at the same time bragging on social media that he’s a gang member and criminal who deserve to be there and Judges have no power to tell them to do anything.

    Trump regularly admits to crimes, then lies saying he never said that and it’s fake news, then admits again and brags no one can stop him, then denies it again and claims anyone talking about it is a hater and loser. This has been going on for decades. His followers are fully on board with this and do not care at all about trying to look for truth and reconcile his lies.

    There is no single reality anymore. People live in their world view silos, and consider anything the other side says as a lie if it conflicts with their world view. Anything can be spun, even if it seems stupid, because people want reinforcement of their world view, not actual reality. Doesn’t matter how weak the argument or evidence for a position is, if someone wants to believe in a certain world view then they will grasp onto the weakest argument and evidence to maintain it.

    The Supreme Court ruled on a very limited basis in “favor” of Trump that a local court cannot literally conduct foreign policy, ie compelling the president to make a deal with a foreign nation. In literally every other factor, they ruled against the administration that every single thing they did was blatantly illegal.

    So basically, conservatives are lying. The basis is “the president can’t be forced to force a deal on another nation by a lower court” and is being used to ignore “every single thing you just did is illegal.” Nobody can make them fix it, but it wasn’t legal to do it or do it again. The courts can’t make Trump make El Salvador return him, they can say “DONT DO THAT AGAIN.”

    TL;DR the opinion said the judge can’t force the administration to do it, but they can force the administration to try and take every every step within their power to do it.

    One sides sees the first half as a victory (SC said you can’t force us) and the other side sees it as a victory (SC says you have to try).

    Because while the SCOTUS said ‘don’t do it again’ and ‘facilitate his return’ they also ruled that the lower courts didn’t have jurisdiction to stop Trump doing it and ‘facilitate’ only means they have to ask el Salvador and help. As we have seen, El Salvador said nope, and the Trump administration shrugged and went oh well we tried…

    So Republicans won on their base argument of jurisdiction and the particular choice of wording means they aren’t forced to try all that hard to get him back. Democrats won in that Trump was told no stop that it’s bad.

    Because the ruling from SCOTUS is carefully worded.

    SCOTUS said the administration needs to “facilitate” the return of Mr. Garcia.

    The lower courts said that the administration needs to “facilitate and effectuate” (IIRC)

    Basically, the lower court said “You need to take steps to make this a possibility, AND make an actual, concerted effort to make it happen”.

    SCOTUS ‘s ruling is basically “You need to take steps to make this a possibility”, they stopped short of ordering that the second half of the lower courts ruling be in effect.

    TLDR, words mean things and different words mean different things, and both sides are too fucking stupid to realize what words mean, so they keep thinking that the ruling is a victory for them.

    Democrats think that “facilitate” means the Trump Administration has to bring him back, Republicans think (correctly) that “facilitate” merely means that the Trump admin has to ask nicely and if the other country refuses, they can wash their hands and say “whelp, we tried”.

    While all of this is going on the vast majority of US citizens are learning that the SCOTUS doesn’t really have any teeth, they only have power so long as people obey their rulings.

    As Jackson said in the aftermath of Worcester V Georgia (1832), paraphrased, obvi, “The SCOTUS has made their decision, now let them enforce it”.
